RESCISSION OF EMERGENCY DESIGNATION OF SHELLFISH LANDS IN THE STATE OF NEW YORK AS UNCERTIFIED FOR

Pursuant to the provisions of Subdivisions 13-0307 (1) and (2) and Subdivision 13-0309 (1) of the Environmental Conservation Law and Sections 42.17 and 47.4 of Title 6 of the Official Compilation of Codes, Rules and Regulations of the State of New York, and based upon the determination that conditions that may cause shellfish to be hazardous for use as food are no longer present, I, Julia Socrates, Acting Director, Division of Marine Resources of the Department of Environmental Conservation, hereby rescind specific sections of the order dated July 17, 2023, that designated particular shellfish lands as uncertified for the harvest of shellfish. This order is effective immediately on Wednesday, July 26, 2023, and applies only to the areas described below, except as described in 6NYCRR, Part 41, “Sanitary Condition of Shellfish Lands”.

Accordingly, the harvest of shellfish from the following areas is permitted:

Town of Southampton: All the normally certified areas of Noyack Creek and Sag Harbor including its tributaries.

Town of East Hampton: All the normally certified areas of Sag Harbor and its tributaries, Northwest Harbor, Northwest Creek, and Montauk Harbor (Montauk Lake).
