What is a “Determination of Potential for Flooding” Form, and do I need to file one?

A “Determination of Potential for Flooding” is required for all new residential dwellings and commercial buildings, including structures that are demolished /destroyed before being subsequently rebuilt. They are not required for renovations or additions to structures that have obtained a valid Certificate of Occupancy (CO) or that have a valid pre-existing Certificate of Occupancy. This determination must be obtained prior to applying for a building permit. The Engineering Division processes the application; however, the inspection of the property and subsequent evaluation of its flooding potential are carried out by the staff of the Highway Department. Applicants must complete the form “Request for Inspection by Highway Department – Stormwater And Driveway Access Determination.
